Article 2. Definitions
The following definitions apply in these terms and conditions of sale according to the meaning indicated below (whether used in the singular or plural).
"General Terms of Sale" refers to this document, the terms and conditions applicable in the relationship between mlittleshop.com and the Customer.
"Order" means the customer's purchase order for one or more products that have been used by the Website.
"Site": refers to the website accessible to the address www.mlittleshop.com published by MCactus.
"Product": refers to a product offered for sale on the Website
"Customer" means a natural or legal person, consumer and/or professional, who uses the Website and acquires one or more Products, for his personal needs, through the website having previously adhered to the General Terms of Sale.
"Recipient" refers to the individual designated by the customer to receive the order.
Article 3. Object
These terms of sale are intended to define:

The conditions applicable to any purchase made on the Site, whether the Customer is of French or foreign nationality.
The acquisition of a product through this site implies an unqualified acceptance by the Customer of all these terms of sale which the Customer acknowledges to have read before his order. If the terms and conditions of the Terms of Sale are not in breach of the terms and conditions of the General Terms of Sale, the Customer must not use the Website.
Only those legally able to take out contracts for products offered for sale on the Site can place an Order. When making the order, the Customer guarantees that he has full legal capacity to adhere to the General Terms of Sale, place an order and close a sale.
The site retains the ability to change its General Sales Terms at any time and without notice. As a result, the applicable conditions will be those in effect on the site on the date of the customer's order.
No general or specific conditions contained in the documents sent or submitted by the Client may be included in these documents, since these documents would be incompatible with the present terms and conditions of Sale.
Article 4. Products
The products on offer are those that appear on the Site within the limit of available stocks. MCactus reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics. The photographs of the products presented on the Site are as faithful as possible but cannot ensure a perfect similarity with the products offered, especially with regard to the colors, and do not engage the Seller.
The sale of the products presented on the Site is intended for all buyers residing in countries that fully authorize the entry into their territory of these products.
Article 5. Price
Prices on the products and services presented on the website are prices in Euros ()16(TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. The Site reserves the right to change its prices at any time, however, with the understanding that the price listed on the day of the order will be the only one applicable to the Customer. The prices shown do not include the delivery fee, charged in addition to the price of the products purchased according to the total amount of the order.
Article 6. Order and Terms of payment
On the first order, the Customer must create an account on the www.mlittleshop.com Site. At each visit, the Customer, if he wishes to order or consult his account (order status, profile...), will have to identify himself using his identifiers and password.
All prices listed are TTC. The total amount of an order is made up of the price of the items and the delivery fee. The price of the products is payable in cash on the day of the actual order. For all settlements, you must use the payment methods offered by the Site on its secure settlement page.
If payment is refused by the authorization centre, we will not be able to ship the order. The Site reserves the right to refuse any order from a customer with whom there is a dispute.
It is specified that simply adding a product to the basket is not worth order validation. In other words, the product may become unavailable between the time the order is added to the basket and the customer's validation of the order. In the event that the product or service is not unavailable after the payment is validated, the Site undertakes to cancel the order of the unavailable product or products and to refund the price paid by the Customer for the unavailable product or products.

Article 7. Property Reserve
MCactus retains full ownership of the products sold until the price is fully collected, including principal, fees and taxes.
Article 8. Withdrawal
In accordance with Article L121-20 of the Consumer Code, the Customer has a period of fourteen (14) free days from receipt of the products to exercise his right of withdrawal, without having to justify reasons or to pay penalties except for the return shipping costs which are at the customer's expense. In order to exercise his right, the Client must e-mail email@example.com his request for withdrawal expressing his willingness to retract and this before the expiry of the withdrawal period.
The refund is due no later than 14 days after the withdrawal request. For a sale of property, the refund is deferred until the day the site recovers the property. The customer will have to return the new item or items in their original packaging, intact and in perfect resale condition, accompanied by all possible accessories, employment notices and documentation. Any product damaged, incomplete, absent or whose original packaging has been damaged, will not be refunded or exchanged and will be sent back to the Customer if requested and at his own expense.
Items on sale or promotion are not picked up or exchanged.
Article 9. Delivery

Products will be shipped within an average of 72 hours subject to product availability. If one or more items are no longer available without this being indicated in the product listing, the Customer is notified by email and the site will refund these items. These deadlines run from the day after the Site receives the customer's payment.
The larger items will be sent taking into account the time frames indicated in the product sheet, in particular to take into account the production times.
Delivery is made at the address indicated on the order with the direct delivery of the product to the advertised recipient, or in case of absence, to another person authorized by the customer. Delays do not have the right to the buyer to claim damages. If you are not present, the parcel can either be dropped off at the post office or the carrier will contact you for a new delivery. For deliveries outside metropolitan France, the customer agrees to pay all taxes due to the import of products, customs duties, value added tax, and any other taxes due under the laws of the country receiving the order. Article 10. Warranty

All products provided by the Site benefit from the legal guarantee provided by Articles 1641 and following of the Civil Code on the condition that the buyer proves the defect hidden within the statutory time frame.
